Terms of Service

Clear guidelines for using our website, accessing information about our programmes and engaging with The New Dimension College.

Last updated: 12 October 2026
These Terms of Service explain the conditions governing access to and use of The New Dimension College website and related information services. Please read them carefully.

1. Introduction

Welcome to The New Dimension College ("the College", "we", "our" or "us"). The College provides educational and training programmes, course information and related services.

These Terms apply to visitors using our website, prospective students making enquiries and, where relevant, students accessing information or services through the website. Separate admission documents, student handbooks, fee schedules and programme-specific rules may also apply.

2. Acceptance of Terms

By accessing or using this website, you agree to comply with these Terms and applicable laws. If you do not agree, please discontinue using the website.

Visiting the website does not by itself constitute admission to the College or create a student-college contract. Admission and enrolment are subject to the College's applicable admission procedures and confirmation.

3. Acceptable Use of the Website

You agree to use the website responsibly and lawfully. You must not:

  • Use the website for fraudulent, unlawful or misleading purposes.
  • Attempt to gain unauthorised access to the website, its hosting environment or any restricted system.
  • Introduce malicious software, harmful code or activities intended to disrupt the website.
  • Copy, misuse or publish another person's personal information without proper authority.
  • Submit false information through an enquiry or application form.
  • Use College branding or content in a way that falsely suggests endorsement or affiliation.

We may take reasonable steps to protect the website and its users when misuse or a security risk is identified.

4. Course and Website Information

We aim to keep course descriptions, entry requirements, programme durations, intake information and fees accurate and current. However, information published online is general information and may change.

  • Confirm current course availability, fees and entry requirements with the College before making payment.
  • Programme duration and study arrangements may depend on the course, timetable and applicable examination requirements.
  • Examination and certification arrangements may be governed by the relevant examining or awarding body.
  • Descriptions of possible career pathways are informational and do not guarantee employment, income or professional registration.

Where published information conflicts with a subsequently confirmed written admission offer or applicable official fee schedule, contact the College for clarification.

5. Admissions and Enrolment

Admission is subject to the programme's entry requirements, submission of required documents, available places and the College's admission procedures.

Applicants are responsible for providing complete and truthful information and authentic supporting documents. The College may verify information where reasonably necessary and lawful.

Submitting an enquiry or application does not guarantee admission. Students should retain their admission letters, receipts and other official enrolment records.

6. Fees, Payments and Refunds

Students are responsible for understanding the fees and payment deadlines applicable to their programme. The applicable fee schedule and written payment instructions should be obtained directly from the College.

  • Confirm the official payment method and recipient before transferring funds.
  • Keep payment receipts and provide them to the College when requested for reconciliation.
  • Additional costs, where applicable, may include examination, registration, learning materials or other disclosed programme-related charges.
  • Any applicable refund, withdrawal, transfer or deferment request will be assessed under the College's relevant written policy, the student's enrolment documents and applicable Kenyan law.

Nothing in these Terms removes any rights a student may have under applicable law. Contact the College administration for a written explanation of a fee balance, payment deadline or refund decision.

7. Student Conduct and Respectful Behaviour

Enrolled students are expected to act respectfully towards fellow students, staff, visitors and College property. Students should comply with applicable College rules, safety procedures, academic integrity requirements and lawful instructions.

Harassment, intimidation, discrimination, violence, deliberate property damage, fraud, cheating and disruption of learning activities may be addressed under the relevant student disciplinary procedures.

Any disciplinary action should follow the applicable College procedures and legal requirements. Students may request information about the relevant procedure from the administration.

8. Attendance, Assessments and Certification

Students should attend scheduled learning activities, complete required coursework and comply with the assessment rules applicable to their programme.

Examination eligibility, registration, assessment, progression and certification may depend on the relevant course requirements and the rules of the applicable examining or awarding body.

The College does not guarantee a particular examination result or certificate. Questions about results, examination registration or certification should be directed to the relevant College office.

9. Intellectual Property

Unless otherwise stated, website text, branding, graphics, photographs, layouts and other materials are owned by the College or used with permission.

You may access and print website information for personal, non-commercial reference. You must not reproduce, sell, republish or materially modify protected material for commercial use without prior permission from the relevant rights holder.

Third-party names, marks and materials remain the property of their respective owners. Nothing in these Terms transfers ownership of intellectual property to a website visitor.

10. Privacy and Personal Data

When you contact the College or submit information through the website, we may process the personal data necessary to respond to your enquiry, handle an application, administer student services, maintain records or meet legal obligations.

Personal data should be handled in accordance with the College's Privacy Policy and applicable Kenyan data protection law, including the Data Protection Act, 2019, where applicable.

Please avoid submitting sensitive personal information through general website forms unless it is requested through an appropriate and secure process.

Read our Privacy Policy for more information about personal data handling and privacy-related enquiries.

11. Third-Party Websites and Services

Our website may link to external websites or services for convenience, including relevant educational, examination or payment resources.

External websites are operated by their respective providers. Unless expressly stated otherwise, the College does not control their content, availability or privacy practices. Review their terms and privacy notices before using those services.

12. Website Availability and Security

We make reasonable efforts to maintain an accessible and secure website. Nevertheless, access may occasionally be interrupted by maintenance, technical issues, hosting problems, connectivity failures or circumstances beyond our reasonable control.

Website visitors should use appropriate device security and verify important information directly with the College. We do not promise that the website will always be uninterrupted, error-free or compatible with every device.

13. Limitation of Liability

To the extent permitted by applicable law, the College is not responsible for losses arising solely from a visitor's reliance on outdated general website information, interruptions beyond its reasonable control or misuse of the website by third parties.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, or removes statutory rights that cannot lawfully be excluded or limited.

14. Changes to These Terms

The College may revise these Terms when necessary to reflect changes in its services, website, operational requirements or applicable law.

The latest version will be published on this page with an updated revision date. Continued website use after a revision means that the revised Terms apply to subsequent website use, subject to applicable law and any separate agreement governing a student's enrolment.

15. Applicable Law and Dispute Resolution

These Terms are governed by the laws of Kenya, subject to applicable mandatory legal protections.

If you have a concern about the website or these Terms, please contact the College first so that the issue can be reviewed. This does not prevent any person from exercising a legal right or pursuing a remedy available under applicable law.
